This Legal Notice applies to comforthaus.shop and all content, products and services offered by Comforthaus ("Comforthaus", "we", "us", "our"). It should be read together with our Terms of Service, Refund Policy, Shipping Policy and Privacy Policy. By using this site or purchasing from us you accept this Legal Notice in full.

1. No warranties

This site, its content and all products sold through it are provided "as is" and "as available". To the fullest extent permitted by law, Comforthaus disclaims all warranties, representations and conditions of any kind, whether express, implied, statutory or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, durability, title and non-infringement. We do not warrant that the site will be uninterrupted, secure or free of errors, viruses or other harmful components, or that any defect will be corrected.

2. Limitation of liability

To the fullest extent permitted by applicable law, Comforthaus and its founder, owners, directors, officers, employees, contractors, agents, suppliers, manufacturers, fulfilment and shipping partners, licensors and service providers (together, the "Comforthaus Parties") shall not be liable for any direct, indirect, incidental, special, consequential, exemplary or punitive damages of any kind, including loss of profits, revenue, data, goodwill or other intangible losses, personal injury, property damage or emotional distress, arising out of or in connection with: (a) your access to, use of, or inability to use the site; (b) any product purchased through the site, including its use, misuse, fit, care, laundering or wear; (c) any delay, non-delivery, loss or damage in production or transit; (d) any error, inaccuracy or omission in content, pricing or availability; (e) any unauthorised access to or alteration of your transmissions or data; or (f) the conduct of any third party on or through the site, in each case whether based in contract, tort (including negligence), strict liability or any other legal theory, and even if a Comforthaus Party has been advised of the possibility of such damages.

Where liability cannot be excluded, the total aggregate liability of the Comforthaus Parties to you for all claims arising out of or relating to the site or any order shall not exceed the amount you actually paid to Comforthaus for the specific product or order giving rise to the claim.

3. Statutory rights

Nothing in this Legal Notice excludes, restricts or modifies any right or remedy, or any guarantee, warranty or term, that is implied or imposed by applicable consumer-protection law and cannot lawfully be excluded, restricted or modified. In those cases our liability is limited to the minimum extent that law permits, which may include replacing the product or refunding the price paid.

4. Made-to-order products and no returns

All Comforthaus products are produced individually after an order is placed. We do not accept returns or exchanges for change of mind, sizing or colour preference. Refunds are available only for manufacturing faults reported with photographic evidence within 30 days of delivery, as set out in our Refund Policy. Minor variances in colour, print placement, texture, finish or measurement are inherent to made-to-order production and are not defects. By ordering you acknowledge that you have checked the size guide and product details and accept these conditions.

5. Product use, care and safety

Our products are garments and accessories intended for ordinary personal wear. You are responsible for using and caring for them in accordance with the care instructions provided. Comforthaus is not responsible for damage caused by improper washing, drying, ironing, bleaching, alteration, abrasion or normal wear and tear, nor for colour transfer, shrinkage or print degradation resulting from such care. Products are not flame-resistant, protective or medical garments and must not be relied on as such. Fibre content and print materials are described on each product page; if you have known skin sensitivities or allergies, review the materials before ordering. Comforthaus is not liable for allergic or other reactions to garment materials, dyes or inks.

6. Accuracy of content and imagery

We try to keep all information on the site accurate, but we do not guarantee that product descriptions, measurements, colours, pricing, availability or other content are complete, current or error-free. Product and campaign imagery is for illustration only. Some imagery features digital models and computer-generated renderings; appearance on a model or rendering does not guarantee how a garment will look or fit on you. Screen settings affect colour reproduction. We reserve the right to correct errors and to cancel or refuse any order placed in reliance on incorrect information, including after the order has been confirmed.

7. Shipping, customs and delivery

Delivery estimates are not guaranteed. Comforthaus is not liable for delays or losses caused by carriers, customs authorities, weather, strikes, pandemics, war, civil unrest, acts of government or any other cause beyond our reasonable control. Any import duties, taxes, brokerage or customs fees levied in the destination country are the responsibility of the recipient. Risk of loss passes to you on delivery to the address you supplied. We are not responsible for orders delivered to an incorrect or incomplete address provided at checkout, or for items left at a delivery location in accordance with the carrier's instructions.

8. Third-party services

Our store runs on Shopify and relies on third-party payment processors, print-on-demand manufacturers, carriers, analytics and marketing providers and other service providers. Those services are governed by their own terms and we are not responsible for their acts, omissions, availability or security. Links to external websites are provided for convenience only; we do not endorse and are not responsible for their content, products, privacy practices or availability.

9. Intellectual property

The Comforthaus name, the angel crest, the Twin Angels and Butterfly artwork, all other logos, prints, designs, photographs, renderings, text, graphics, code and the overall look and feel of the site are owned by or licensed to Comforthaus and are protected by copyright, trademark and other intellectual-property laws. No licence or right is granted to you except the limited right to view the site for personal, non-commercial shopping. You may not copy, reproduce, modify, distribute, display, perform, publish, sell, create derivative works from, scrape or otherwise exploit any content or product design without our prior written consent. Unauthorised use may result in civil and criminal liability.

10. User content and reviews

Any review, comment, photograph or other material you submit to the site or tag to Comforthaus on social media may be used, edited, reproduced and displayed by us in any medium without compensation. You represent that you own or control all rights in such material, that it is accurate, and that it does not violate the law or the rights of any third party. We may remove any user content at our discretion and are not responsible for the content or opinions of other users.

11. Indemnification

You agree to indemnify, defend and hold harmless the Comforthaus Parties from and against any and all claims, demands, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of or relating to your breach of this Legal Notice or our Terms of Service, your violation of any law or the rights of a third party, your misuse of any product, or any content you submit.

12. No professional advice

Content on the site, including size guidance, care instructions, blog posts and social media, is provided for general information only and does not constitute professional, medical, safety or other advice. You rely on it at your own risk.

13. Availability, pricing and orders

All products are offered subject to availability. Prices are shown in the currency selected and may change without notice. We may limit quantities, refuse or cancel any order, or discontinue any product at any time. Promotional offers may be withdrawn without notice. A confirmation email is an acknowledgement of your order, not an acceptance; a contract is formed only when the order is dispatched.

14. Force majeure

Comforthaus shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, epidemics, fire, flood, war, terrorism, civil disturbance, labour disputes, supplier or carrier failure, government action, utility or internet outages, or cyber-attack.

15. Governing law and disputes

This Legal Notice is governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Subject to any non-excludable consumer rights, you agree that any dispute arising out of or relating to the site or any order shall be brought exclusively in the courts of British Columbia, Canada, and you submit to the jurisdiction of those courts. Any claim must be commenced within one (1) year after the cause of action arises, failing which it is permanently barred.

16. Severability, waiver and changes

If any provision of this Legal Notice is held unenforceable, it shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force. Our failure to enforce any right or provision shall not constitute a waiver of that right or provision. We may update this Legal Notice at any time by posting a revised version on this page; your continued use of the site after changes are posted constitutes acceptance.
